OpenCxMS Technologies, Inc. is a Pennsylvania Public Benefit Corporation. Our products include CxMS Pro (persistent AI memory for coding assistants) and the BYOK AI App (mobile AI chat with persistent memory).

Our Commitment

We do not sell, distribute, share, rent, or trade your personal information with third parties. Period. Your information is used only to provide our services and support your account.

What We Collect

Account Information

When you purchase a product, we collect:

  • Name and email address (for account creation and support)
  • Payment information (processed by our payment processor; we do not store card numbers)
  • Organization name (if provided)

CxMS Pro Telemetry

CxMS Pro collects minimal, anonymized usage telemetry:

  • Tool usage counts (e.g., “memory search called 12 times”)
  • Memory node statistics (aggregate counts, not content)
  • Session duration
  • Node.js version and operating system platform

We never collect: your code, file names, file contents, memory content, prompts, AI responses, or any intellectual property. The telemetry hooks ship as readable source code so you can verify exactly what is transmitted.

BYOK AI App

The BYOK app stores all data on your device. Your API keys, conversations, and memory are never transmitted to our servers. The only data we receive is your account email for license validation.

Website

Our website uses privacy-focused analytics for basic traffic metrics (page views, visitor counts). No personal data is collected through analytics. Contact and support form submissions are stored in our database and used only to respond to your inquiry.

How We Use Your Information

Your information is used exclusively to:

  • Create and manage your account
  • Process payments and manage subscriptions
  • Provide customer support
  • Send transactional emails (account verification, license delivery, support responses)
  • Improve our products based on aggregated, anonymized usage patterns

We do not send marketing emails unless you explicitly opt in. We do not use your data for advertising. We do not share your data with analytics companies, ad networks, or data brokers.

Third-Party Services

We use the following categories of services to operate our business:

  • Payment processor — Handles all payment data under their own privacy policy. We do not store card numbers.
  • Cloud database — Account data is stored with row-level security and encryption at rest.
  • Website hosting — Serves our website with basic, privacy-focused analytics (no personal data).
  • Transactional email — Delivers account verification, license keys, and support notifications.

None of these services receive your code, AI memory content, or intellectual property.

Data Retention

  • Account data: Retained while your account is active. Deleted upon request after account closure.
  • Telemetry data: Aggregated and anonymized. Individual session data is retained for 90 days, then purged.
  • Support tickets: Retained for 2 years after resolution for quality assurance, then deleted.
  • Your AI memory (CxMS Pro): Stored on your machine only. We never have access to it. If you cancel, your data stays on your machine.
  • Your AI memory (BYOK App): Stored on your device only. Deleting the app deletes the data.

Your Rights

You have the right to:

  • Access all personal data we hold about you
  • Correct inaccurate information
  • Delete your account and all associated data
  • Export your data
  • Opt out of telemetry (CxMS Pro: run node tools/cxms-report.mjs --revoke)

Children's Privacy

Our products are not directed at children under 13. We do not knowingly collect personal information from children.

Changes to This Policy

We may update this policy as our products evolve. Significant changes will be communicated via email to active account holders. The “Last updated” date at the top reflects the most recent revision.
